29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  a) Production area: On or about September 17, 2019, and at times prior, the employer exposed the machine operator to noise levels above the action level of 85 decibels (50% dose) without providing an audiometric test.  The employee had an exposure of 86.4 decibels (66.5% dose) during the 346 minute sampling period. The exposure calculation included a zero increment for the 134 minutes not sampled.

The employer did not institute a training program and ensure employee participation in the program:  a) Production area: On or about September 17, 2019, and at times prior, the employer exposed the machine operator to noise levels above the action level of 85 decibels (50% dose) without providing noise training.  The employee had an exposure of 86.4 decibels (66.5% dose) during the 346 minute sampling period. The exposure calculation included a zero increment for the 134 minutes not sampled.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a) Production area: On or about September 5, 2019, and at times prior, the employer exposed employees to struck-by hazards, in that employees were not provided formal instruction prior to driving the Mitsubishi forklift.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Production area: On or about September 5, 2019, and at times prior, the employer exposed employees to chemical hazards, in that a written hazard communications program with all required elements was not established or provided to employees working with chemicals, such as but not limited to, propane gas, O'Reilly hydraulic oil, Kleen Strip Paint Thinner, and O'Reilly antifreeze & coolant.
