29 CFR 1910.1020(d)(1)(ii): "Employee exposure records." Each employee exposure record shall be preserved and maintained for at least thirty (30) years, except that: a. On or about September 9, 2019, the employer failed to preserve and maintain employee exposure records. The employer had performed employee exposure monitoring of the workplace adjacent to the Line 5 Fryer for the toxic substance carbon monoxide and did not maintain the applicable air monitoring exposure record(s).

29 CFR 1910.1020(g)(1): Upon an employee's first entering into employment, and at least annually thereafter, each employer shall inform current employees covered by this section of the following: 29 CFR 1910.1020(g)(1)(i): The existence, location, and availability of any records covered by this section; 29 CFR 1910.1020(g)(1)(ii): The person responsible for maintaining and providing access to records; and 29 CFR 1910.1020(g)(1)(iii): Each employee's rights of access to these records. a. On or about September 9, 2019, the employer failed to notify employees upon entry into employment and on an annual basis of existence, location, and availability of employee exposure records; the person responsible for maintaining and providing access to employee exposure records; and employee right to access employee exposure records. The employer was required to maintain employee exposure records, such as, but not limited to, carbon monoxide workplace area monitoring performed in association with a documented Fryer 5 emission source of carbon monoxide on August 28, 2019.
