29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:     a) On September 17, 2019, employees performing HVAC work were not protected from fall hazards of approximately 40 feet to the ground while working near an unprotected wall opening.      No abatement certification or documentation is required for this item.

29 CFR 1926.1052(c)(4): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members were not provided between the top rail of the stairrail system and the stairway steps:       a) On September 17, 2019, employees used a stairway to access the fourth floor of the building where the stairrail system did not have a midrail installed between the top rail of the stairrail system and the stairway steps.      In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
