OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to combustible agricultural ingredients dust explosion, deflagration and other fire hazards while working near or upstream of multiple unprotected indoor dry-type filters:    (a)   On or about December 3, 2019 the CPE Filters, Inc. model 100-NF-100-C filter media dust collector servicing equipment in Rooms 7, 8, and 9 was located in Mechanical Room Building A  West Wall Production and collected combustible agricultural ingredients dust.  The indoor dust collector lacked means of (1) explosion protection and (2) deflagration propagation protection (isolation) for the upstream processes via the dirty air inlet ducting and the area beneath the dust collector via the material hopper discharge.      (b)   On or about December 3, 2019 the CPE Filters, Inc. model 84-NF-036-C filter media air-material separator servicing equipment in Room 11 was located in Room 11 and collected combustible agricultural ingredients dust.  The indoor air-material separator lacked means of (1) explosion protection and (2) deflagration propagation protection (isolation) for the upstream processes via the dirty air inlet ducting and the area beneath the unit via the material hopper discharge.      (c)   On or about December 3, 2019 the Donaldson Torit DLMC model 23257 filter media dust collector servicing equipment in Rooms 10, 13, 14, 15, 16, 17, 18, and 19 was located in Building A  East Wall and collected combustible agricultural ingredients dust.  The indoor dust collector returned air into the occupied building and lacked means to prevent the return of the hazardous byproducts of a fire (i.e. smoke, toxic gases, etc.) to the room.      (d)   On or about December 3, 2019 the Herding Filtration, LLC model RESIST 1500-10/12 DR DN1400 W82 filter media air-material separator servicing equipment in Room 19 was located in the upstairs of Room 19 and collected combustible agricultural ingredients dust.  The indoor air-material separator returned air into the occupied building and lacked means to prevent the return of the hazardous byproducts of a fire (i.e. smoke, toxic gases, etc.) to an adjacent hallway.  The air-material separator also lacked means of deflagration propagation (isolation) for the exhaust air outlet.
