29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On December 3, 2019, located on the east side of a commercial exterior structure, there were no frequent and regular inspections being performed by a competent person to ensure an employee while operating a Skyjack Telescopic Boom Lift was utilizing equipment such as a harness and lanyard attached to the boom or basket.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On December 3, 2019, located on the east side of a commercial exterior structure, an employee was exposed to a fall hazard while performing painting work standing inside a Skyjack Telescopic Boom Lift basket Model SJ66T without being attached to the boom or basket. Potential fall height measured to be greater than 25 feet.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: a) The nature of any electrical hazards, b) fall hazards, and c) falling object hazards in the work area. On December 3, 2019, located on the east side of a commercial exterior structure, an employee operating a Skyjack Telescopic Boom Lift had not received training by the employer to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.
