29 CFR 1926.1203(e)(2)(ii): When entrance covers were removed the opening was not immediately guarded by a railing, temporary cover, or other temporary barrier that would prevent an accidental fall through the opening and that would protect each employee working in the space from foreign objects entering the space.  a) Bedrock Earthworks located at 5015 Big Run South Road Grove City, OH 43123:  On and preceding January 27, 2020, the employer did not ensure that manhole openings were guarded to protect employees from falling into a sewer and protect the employee working in the sewer from objects falling into the sewer.  An employee entered a sewer to make repairs with the entrance cover removed and no type of barrier installed at the opening.  The following condition exposed employees to falls in excess of 20 feet and struck-by hazards.

An employee entered a sewer to make repairs and upon falling into the space, non-entry rescue equipment was not utilized and an unauthorized person entered the space.

29 CFR 1926.1211(c): (c) Non-entry rescue is required unless the retrieval equipment would increase the overall risk of entry or would not contribute to the rescue of the entrant. The employer must designate an entry rescue service whenever non-entry rescue is not selected. Whenever non-entry rescue is selected, the entry employer must ensure that retrieval systems or methods are used whenever an authorized entrant enters a permit space, and must confirm, prior to entry, that emergency assistance would be available in the event that non-entry rescue fails. Retrieval systems must meet the following requirements:   a) Bedrock Earthworks located at 5015 Big Run South Road Grove City, OH 43123:  On and preceding January 27, 2020, the employer did not ensure that retrieval systems or methods were used when they entered a sewer and did not confirm, prior to entry, that emergency assistance were available. A crew was performing work that required entry into a confined space.  There was a mechanical tripod on-site but not used and no contact was made with emergency services prior to entry to confirm availability.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) Bedrock Earthworks located at 5015 Big Run South Road Grove City, OH 43123:  On and preceding January 27, 2020, the employer did not ensure that a work-related incident resulting in an in-patient hospitalization was reported within 24 hours. An incident resulting in an employee hospitalization occurred on January 27, 2020 at approximately 9 am. At approximately 11 am, the employee was flown to the hospital where he was met by company supervision.  The employer did not report the in-patient hospitalization.  The CSHO arrived at the job site at 9 am on January 30, 2020 based on a media referral.
