29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  (a) Facility Wide - On February 4, 2020, the employer did not ensure that authorized forklift operators were provided an evaluation of their performance once every three years.   In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  (a) Facility Wide - On February 4, 2020, the employer failed to certify that each temporary employee authorized to operate forklifts were certified after being evaluated with certification records that includes the name of the operator, the date of the training, the date of the evaluation and the identity of the person performing the evaluation.   In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. 29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed:  (a) Packaging Department - On February 4, 2020, the employer failed to ensure that exit routes were kept free and unobstructed.  An exit door leading to the outside was obstructed by pallets containing product.      No abatement certification or documentation is required for this item.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s)  (a) Facility Wide -  On February 4, 2020, the employer failed to ensure that all powered industrial trucks that were found to be in need of repair or were in anyway unsafe were removed from service until they had been restored to a safe operating condition. The sit down #18 Hyder forklift was in operation without a working horn to caution employees when entering blind spots.   In accordance with the requirements of 29 CFR 1903.19(c), abatement certification only is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET.
