29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of copper fumes listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 0.10 milligrams per cubic meter of air: (a) On or about March 12, 2020, the welder in welding station #1 was exposed to copper fumes at an 8-hour time weighted average of 0.157 milligrams per cubic meter of air, approximately 1.57 times the limit of 0.10 milligrams per cubic meter of air. The sample was collected on March 12, 2020 during a 456 minute sampling period and exposure calculations include a zero increment for the 24 minutes not sampled.

The sample was collected on March 12, 2020 during a 456 minute sampling period and exposure calculations include a zero increment for the 24 minutes not sampled.

29 CFR 1910.1000(e): On or about March 12th 2020, and days prior, administrative or engineering controls including but not limited to localized exhaust ventilation designed to limit employee exposure to air contaminants were not implemented by the employer whenever feasible. (a) The welder in welding station #1 was exposed to copper fumes at an 8-hour time weighted average of 0.157 milligrams per cubic meter of air, approximately 1.57 times the limit of 0.100 milligrams per cubic meter of air. The sample was collected on March 12, 2020 during a 456 minute sampling period and exposure calculations include a zero increment for the 24 minutes not sampled. The existing control measures, including administrative and engineering controls, were not adequate to limit the exposure of employees to copper fume to or below the PEL. No localized exhaust ventilation was available. (b) The welder in welding station #1 was exposed to iron oxide fumes at an 8-hour time weighted average of 12.3 milligrams per cubic meter of air, approximately 1.23 times the limit of 10.0 milligrams per cubic meter of air. The sample was collected on March 12, 2020 during a 456 minute sampling period and exposure calculations include a zero increment for the 24 minutes not sampled. 29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment. (a) On or about March 12, 2020, employer did not administer a continuing, effective hearing conservation program. An evaluation of the responses from employers and employees questioning the hearing conservation program revealed a lack of uniform understanding on hearing protection requirements while on the production floor and when employee exposure to hazardous noise sources need to be evaluated.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a noise monitoring program in order to identify employees for inclusion in the hearing conservation program. On or about March 12, 2020, a program to monitor employee work tasks and changing work environment due to change in production equipment and work processes, was not developed to ensure continual assessment of noise exposure to employees. (a) An employee performing large tank assembly in the large tank assembly area was exposed to a cumulative noise dose of 82.31% during a 414 minute sampling period on March 12, 2020. This noise exposure equated to an 8-hour hearing conservation program threshold time-weighted average (TWA) sound level of approximately 88.6 dBA, which is above the action level of 85dBA .
