29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   a) Porter Drywall, Inc., at a worksite located at 20 Olentangy Meadows Drive, Lewis Center, Ohio, 43035: On and/or preceding February 20, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Employees were throwing scrap pieces of drywall from the unguarded deck of the third story. The employees were not utilizing any form of fall protection, which exposed them to falls up to 20 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a) Porter Drywall, Inc., at a worksite located at 20 Olentangy Meadows Drive, Lewis Center, Ohio, 43035: On and/or preceding February 20, 2020, the employer failed to train employees on fall hazards and the procedures required to be followed to minimize those hazards, thereby exposing employees to a 20 foot fall hazard.
