29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Work site was located at 321 NJ 440, Jersey City, NJ 07305  Employees were working inside an open trench that had the material from the spoil pile including rocks and debris placed at the edge of the trench. Employees working inside were not wearing a hardhat and were thereby exposed to over head hazards.  Violation was observed on or about February 27, 2020.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) Work site was located at 321 NJ 440, Jersey City, NJ 07305  Employees were working in an open trench that was approximately seven feet, four inches deep and approximately four feet, nine inches wide that had the spoils pile sitting on top of the sidewall with no set back from the top of the excavation. The spoils pile was approximately three feet high.  Violation was observed on or about February 27, 2020.
