29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about March 05, 2020, located at 1482 E Mary Lou Drive (Lot #132), Pataskala, Ohio, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while employees installed shingles at the worksite.  Three employees were unprotected off the roof top of a two story new build residential home.  The fall distance was approximately 16 feet from the roof's eave to the ground level.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. On or about March 05, 2020, located at 1482 E Mary Lou Drive (Lot #132), Pataskala, Ohio, the employer failed to instruct employees on the avoidance of unsafe conditions while they installed shingles on the roof top of a new build residential home.  Three employees were unprotected off the roof top of a two story new build residential home.  The fall distance was approximately 16 feet from the roof's eave to the ground level.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about March 05, 2020, located at 1482 E Mary Lou Drive (Lot #132), Pataskala, Ohio, the employer failed to ensure employees working to install shingles were protected from falling from the rooftop. The employees were exposed to a fall hazard of approximately 16 feet from the roof's eave to the ground level.
