29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.    On or about March 11th, 2020, the employer did not ensure that inspections were conducted by a person who was competent, on an open trench that was approximately twelve (12) foot long x five (5) foot wide x seven (7) foot in depth.

29 CFR 1926.652(a)(1):  Employees in excavations were not protected from cave-ins by an adequate protective system designed in accordance with paragraphs (b) sloping and benching or (c) support/shield/protective systems of this section:      On or about March 11th, 2020, the employer failed to provide cave-in protection such as sloping, benching, or use of a trench box when employees were working in an excavation approximately seven (7) feet, two (2) inches in depth, approximately five (5) feet wide, approximately twelve (12) feet in length, and comprised of material consistent with that of a Type B soil.
