29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 372 Nandina Loop, Lot 40 Firethorne, Fairhope , Alabama:  On or about March 17, 2020 and at times prior; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of up to 20 feet 9 inches to the ground below.   THE JUAN GARCIA DBA JUAN GARCIA WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER  1439315, CITATION NUMBER 1, ITEM NUMBER 1, GROUP A AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 23, 2019,  WITH RESPECT TO A WORKPLACE LOCATED AT 26036 GILMORE WAY, LOT 118 WINGED FOOT, DAPHNE, ALABAMA AND IN INSPECTION NUMBER  1454217, CITATION NUMBER 2, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON MARCH 4, 2020,  WITH RESPECT TO A WORKPLACE LOCATED AT 4161 CRAIGEND LOOP, LOT 348 CRAFT FARMS, GULF SHORES, ALABAMA.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At 372 Nandina Loop, Lot 40 Firethorne, Fairhope , Alabama:  On or about January 7, 2019 and at times prior; the employer allowed his employees to perform framing activities without first ensuring his employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 19 feet 3 inches to the ground below.
