OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushing hazards:   a) At 18485 South Dixie Hwy, Cutler Bay, Florida 33157: On or about 04/09/2020, the employer did not ensure employees remain clear of suspended loads and permitted employees to work in close proximity to a front-end loader that was lifting and moving a palm tree during planting operations.  b) At 18485 South Dixie Hwy, Cutler Bay, Florida 33157: On or about 04/09/2020, the employer did not ensure a safety latch was installed on the hook when using a custom-made lifting attachment, connected to the bucket, and the attachment was not approved or tested by the manufacturer or equivalent entity, to determine the rated capacity and to prevent the load from being dislodged during the lifting and moving of a palm tree during planting.
