On or about June 12, 2020, at the above address, an employee was required to operate a rough terrane forklift and had not been provided with training, including but not limited to formal instruction, practical training and an evaluation of the operators performance, thereby exposing employees to struck by and crushing hazards.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a.  On or about June 12, 2020, at the above addressed jobsite, employees conducting masonry operations from a welded frame metal scaffold, thirteen (13) feet two (2) inches above the ground, was not provided with safe access to a ladder, thereby exposing the employee to falls.

On or about June 12, 2020, at the above addressed jobsite, employees performing masonry operations from a tubular welded frame scaffold, thirteen (13) feet two(2) inches above the ground, were exposed to injuries from falls due to the lack of guardrails.
