The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: On or about 06/22/2020 at the 101 Albany Turnpike Construction Project, two employees were working from an aerial lift with no personal fall protection system in use.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: On or about 06/19/2020 at the 101 Albany Turnpike Construction Project, two employees were working from an aerial lift and were using personal fall protection systems that did not prevent the employees from contact with lower levels.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about 06/22/2020 at the 101 Albany Turnpike Construction Project, the foreman and employee were using a fiberglass extension ladder to access the trusses and the ladder did not extend 3 feet past the landing.
