29 CFR 1926.1203(a): Before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may have worked, and/or did not identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary:    (a) 5141 Rockery Road Spring Grove PA Thickener Tank - The employer did not identify the permit required confined space before the employees entered the thickener tank and began working, exposing employees to a potentially oxygen deficiency atmosphere, on or about July 2, 2020.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1203(e)(2)(iii): Before an employee entered the space, the internal atmosphere was not tested with a calibrated, direct-reading instrument, for oxygen content, for flammable gases and vapors, and for potential toxic air contaminants, in that order:    (a) 5141 Rockery Road Spring Grove PA Thickener Tank - The employer did not take an atmospheric test before the employees entered the permit required confined space of the thickener tank and began working, exposing employees to a potentially oxygen deficiency atmosphere, on or about July 2, 2020.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1203(e)(2)(vi): The employer did not continuously monitor the atmosphere of the Permit-Required Confined Space and did not demonstrate that equipment for continuous monitoring was not commercially available or periodic monitoring was sufficient:  (a) 5141 Rockery Road Spring Grove PA Thickener Tank - The employer did not have equipment for continuous monitoring before the employees entered or while in the permit required confined space of the thickener tank and began working, potentially exposing employees to an atmospheric hazard, on or about July 2, 2020.   Abatement Note: If continuous monitoring is used, the employer must ensure that the monitoring equipment has an alarm that will notify all entrants if a specified atmospheric threshold is achieved, or that an employee will check the monitor with sufficient frequency to ensure that entrants have adequate time to escape. If continuous monitoring is not used, periodic monitoring is required. All monitoring must ensure that the continuous forced air ventilation is preventing the accumulation of a hazardous atmosphere. Any employee who enters the space, or that employee's authorized representative, must be provided with an opportunity to observe the testing   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
