Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crush-by and/or drowning hazards while operating ride-on zero turn mowers near a retention pond with slopes greater than fifteen degrees;  a)  At the pond located immediately behind 7 Parrot Place in North Fort Myers, FL, employees  were exposed to crush-by and drowning hazards while operating a ride-on zero turn mower on slopes greater than 15 degrees in close proximity to a water retention pond.
