29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:     On or about July 30, 2020, at a job-site located at 4450 Woodstone Ave NW, Massillon, Ohio 44647; the employer did not ensure employees were protected from head injuries from falling dirt and rocks from material being excavated while working in a trench with the spoil pile directly at the edge and material being excavated and placed on the spoil pile while the employee was working below.       The Lockhart Concrete Co was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.100(a) Head Protection, which was contained in OSHA inspection number 1084452, citation number 01, item number 01 and was affirmed as a final order on (1/30/2018), with respect to a workplace located at Adaline Dr, Stow, Ohio 44224.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.     On or about July 30, 2020, during the installation of storm water line at 4455 Woodstone Ave NW, Massillon, Ohio 44647, the employer did not ensure spoil piles (excavated dirt and rock) were kept at least 2 feet from the edge of an open trench where employees were working directly below the spoil pile.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).       On or about July 30, 2020, at a job-site located at 4455 Woodstone Ave NW, Massillon, Ohio 44647; the employer did not ensure adequate cave-in protection was used to protect an employee working inside a trench with near vertical side walls and a depth of approximately 5.3 feet.  The trench was determined to have type "B" soil.      The Lockhart Concrete Co was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.652(a)(1) Requirements for protective systems, which was contained in OSHA inspection number 1084452, citation number 02, item number 02 and was affirmed as a final order on (1/30/2018), with respect to a workplace located at Adaline Dr, Stow, Ohio 44224.
