Employees were overcome with fumes when instructed to use Vortexx as a foaming agent.

29 CFR 1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) On or about October 8, 2020, and at times prior, Sinton Dairy Foods Company, LLC, at 3801 Sinton Rd., Colorado Springs, CO 80907, did not ensure that employees conducting cleaning operations in the filler room were properly trained in the use and hazards of chemicals such as but not limited to Vortexx, when used as a foaming agent. (b) On or about October 8, 2020, and at times prior, Sinton Dairy Foods Company, LLC, at 3801 Sinton Rd., Colorado Springs, CO 80907, did not ensure that employees conducting cleaning operations in the filler room were properly trained in detecting the presence or release of hazardous chemicals such as but not limited to Vortexx, when used as a foaming agent.
