29 CFR 1926.1417(c)(1): The procedures applicable to the operation of the equipment, including rated capacities (load charts), recommended operating speeds, special hazard warnings, instructions, and operator's manual, were not readily available in the cab at all times for use by the operator:  (a)	On or about October 13, 2020, for the employee operating a Caterpillar 583K pipelayer that was being utilized in a multiple-piece lift of a 296 foot pipestring, the employer did not ensure that the operators manual was available during pipeline construction activities, in the vicinity of State Highway Five & 52nd Street NW in Williston, North Dakota.

29 CFR 1926.1422: The employer did not ensure that hand signal charts were posted either on the equipment being used or conspicuously posted in the vicinity of hoisting operations:   (a)	On or about October 13, 2020, for the employees engaged in a multiple-piece lift of a 296 foot pipestring, the employer did not ensure that the hand signals to be utilized by signal persons on the jobsite were posted either on the equipment or in the area of the hoisting operation during pipeline construction activities, in the vicinity of State Highway Five & 52nd Street NW in Williston, North Dakota.

29 CFR  1926.1428(a):The employer of the signal person did not ensure that each signal person met the Qualifications Requirements (paragraph (c) of this section) prior to giving any signals:  (a)	On or about October 13th, 2020, for the employees engaged in a multiple-piece lift of a 296 foot pipestring, the employer did not ensure that assigned signal persons were trained and consistently utilizing a standard method for crane signaling, and that assigned signal persons were properly tested through an oral or written exam, during pipeline construction activities in the vicinity of State Highway 5 & 52nd Street NW in Williston, North Dakota.
