29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  a) 2745 North Hampton Street Easton, PA: On or about December 10, 2020, employees were exposed to potential cave-in hazards associated with trenching when a competent person did not inspect the trench prior to employees entering.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  a) 2745 North Hampton Street Easton, PA: On or about December 10, 2020, employees were exposed to the hazards associated with engulfment while performing work in a 7 foot 4 inch trench where adequate cave-in protection was not used.  No abatement certification or documentation is required.

29 CFR  1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) 2745 North Hampton Street Easton, PA: On or about December 10, 2020, employees working in a trench were exposed to fall hazards during egress from the trench due to no stairway, ladder, ramp or other safe means of egress being provided.  No abatement certification or documentation is required.
