29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On or about December 16, 2020, during the removal and installation of roofing material on a two story residential townhome located at 100 and 102 Pebble Court, Berea, Ohio, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to their work environment to control and eliminate fall hazards associated with working from a roof approximately 20 feet above the ground.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about December 16, 2020, during the removal and installation of roofing material on a two story residential townhome located at 100 and 102 Pebble Court, Berea, Ohio, the employer did not ensure employees working from the roof were protected from a fall of approximately 20 feet (2 stories), by utilizing a guardrail system, safety net system and/or personal fall arrest system.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  On or about December 16, 2020, the employer did not report within 24 hours the in-patient hospitalization injury of an employee who fell approximately 20 feet from a residential roof, while performing roofing work, at a worksite located at 100 and 102 Pebble Court, Berea, Ohio.  OSHA was not notified of the in-patient hospitalization injury until on or about December 21, 2020, by the Berea, Ohio Police Department.
