29 CFR  1910.178(l)(4)(ii)(B): Refresher training and evaluation was not provided to the powered industrial truck operator when the operator was involved in an accident or near-miss incident.   Pilkington North America, Inc. - Rossford, Ohio: On or about February 10, 2021, the employer failed to ensure that a forklift operator involved in a near-miss incident was retrained in topics relevant to safe operations of powered industrial trucks.   On or about January 7, 2021, a forklift operator dropped an empty load of racks after striking an overhead installation and was permitted to operate a forklift without refresher training following the near-miss.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.178(m)(8): Sufficient headroom was not provided under overhead installations, lights, pipes, sprinkler system, etc:  Pilkington North America, Inc. - Rossford, Ohio: On or about January 7, 2021, the employer did not ensure sufficient headroom was provided under the encapsulation electrical transformer installation for loads carried by forklifts.  Employees were exposed to struck-by hazards from forklift loads that hit the installation and fall from the forklift.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
