29 CFR  1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part.   a) On February 22, 2021 and at times prior to; the controlling employer failed to correct hazards and enforce safety controls; subcontractor employees were exposed to hazards including but not limited to: falls from 17 to 22 feet while sheathing a 5:12 roof, falls from 9.5 feet while installing drywall, and exposure to eye and head injuries when performing tasks without the appropriate personal protective equipment.   * Note - Abatement certification AND documentation are required.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) On February 22, 2021 and at times prior to, the controlling employer did not ensure that its subcontractor protected its employees from fall hazards of 17 to 22 feet on a 5:12 roof while performing sheathing activities.   b) On February 22, 2021, the controlling employer did not ensure that its subcontractor protected its employee  from a 9.5 foot wall while installing drywall sheets from the top of an unfinished wall.    * Note - Abatement certification AND documentation are required.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On February 22, 2020 and at times prior to; subcontractor employees operating pneumatic nail guns and Makita XSR01 7 1/4" 36 volt Cordless Circular Saws were not provided safety glasses to prevent wood chips and dust from exposing them to eye abrasions or punctures.
