29 CFR 1926.451(a)(1): Scaffold(s) and scaffold(s) component(s) were not capable of supporting, without failure, its own weight and at least four times the maximum intended load applied or transmitted to it: On or about February 23, 2021, at the jobsite, the employer allowed employees to work from a shop made scaffold platform that was elevated by a powered industrial truck. The scaffold platform extended more than ten (10) inches over the wheel base of the powered industrial truck and this exposed the employees to a fall hazard.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: On or about February 23, 2021, at the jobsite, the employer allowed employees to work from a shop made scaffold that was elevated by a powered industrial truck. The employer did not obtain written approval from the manufacturer to use this powered industrial truck to elevate the scaffold with personnel and this exposed the employees to a fall hazard.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. On or about February 23, 2021, at the jobsite, the employer required employees to perform roofing work activities from a roof of a commercial building. The employees were not in use of fall protection and were exposed to a fall greater than six (6) feet to the ground below.
