29 CFR 1910.178(o)(1): The employer did not ensure that only stable or safely arranged loads were handled: a) Jobsite, 294 Alpha Drive, Pittsburgh, PA 15238: On or about April 2, 2021, a Hyster brand powered industrial truck (model number: E40HSD, serial number: A219N02053B) was operated with a backrest that was bent forward. The bend in the backrest prevented forklift operators from being able to place loads flush against the backrest which reduced the distance the forks could be reach under each load. The bottom of the totes containing VanWet 9N9 (product number 808214) surfactant had several indentations on the bottom which could lead to instability while elevated on forks of the forklift. Employees working in areas where the forklift was being used to lift and transport chemical totes weighing up to approximately 2,662 pounds when full were exposed to crushed-by and struck-by hazards.

29 CFR 1910.178(o)(6): Elevated loads were tilted forward when the load was not in a deposit position over a rack or stack: a) Jobsite, 294 Alpha Drive, Pittsburgh, PA 15238: On or before April 2, 2021, employees use forklifts, including a Hyster brand powered industrial truck (model number: E40HSD, serial number: A219N02053B), to elevate totes so that the contents of the totes can be transferred to buckets and barrels. For some style of totes the employees must tilt the tote forward while it is on the to the forks to get the last amounts of product to drain from the tote. Employees are exposed to struck-by and crushed-by hazards while working directly in front of a tote that is elevated and tilted forward on the forks of the forklift.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a) Jobsite, 294 Alpha Drive, Pittsburgh, PA 15238: On or about April 2, 2021, a Hyster brand powered industrial truck (model number: E40HSD, serial number: A219N02053B) that was not in safe operating condition was not taken out of service and/or repaired by authorized personnel. The load backrest was bent forward making it impossible to place totes flush against the backrest. Employees working in areas where the forklift was being used to lift chemical totes weighing up to approximately 2,662 pounds were exposed to crushed-by and struck-by hazards. b) Jobsite, 294 Alpha Drive, Pittsburgh, PA 15238: Observed on or about July 27, 2021, a Yale forklift (Model Number: 162G Serial Number 5021352-01) was not in safe operating condition. The battery did not properly fit and a piece of wood was wedged between the battery and the frame of the forklift to hold it in place. Additionally, the forklift manual was not kept with the forklift.
