29 CFR  1926.416(a)(3):  Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit:  On or about March 31, 2021 at the intersection of Old Jenny Lind Loop and Highway 71, the employer did not inquire by direct observation or by use of an instrument if it was safe to raise the bed of a dump truck to pour asphalt into a shuttle buggy transfer machine below overhead power lines that were energized.

29 CFR  1926.600(a)(6)(i):  For lines rated 50kV or below, a minimum of 10 feet was not maintained between the energized line and the equipment:  On or about March 31, 2021, at the intersection of Old Jenny Lind Loop and Highway 71, the employer did not ensure that the bed of a dump truck pouring asphalt into a shuttle buggy transfer machine was at least 10-feet away from overhead power lines rated at about 19.9/34.5kV.  This practice created a condition, which exposed employees to electrical burn hazards.

29 CFR  1926.600(a)(6)(iv):  A person was not designated to observe clearance of the equipment and give timely warning for all operations where it is difficult for the operator to maintain the desired clearance by visual means:  On or about March 31, 2021, at the intersection of Old Jenny Lind Loop and Highway 71, the employer did not designate a person with knowledge to warn a dump truck driver and shuttle buggy transfer machine operators to maintain at least 10-feet from energized overhead power lines.  This practice created a condition, which exposed employees to electric shock hazards.
