29 CFR 1926.501(a)(2):The employer did not determine if the walking/working surfaces on which its employees were to work on, had the strength and structure integrity to support employees safely. Employees were allowed to work on those surfaces when the surfaces did not have the requisite strength and structural integrity: a) At the facility, 1050 Elizabeth St. Ext, Mechanicville, NY 12118 - Building roof - On or about May 17, 2021, employees were working on the roof of the building, replacing rotted decking. The employer allowed employees to work on decking that did not have the strength and structural integrity to support the employees. An employee fell through the damaged/rotted roof decking, resulting in fatal injuries.

29 CFR 1926.501(b)(4)(i):Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: a) At the facility, 1050 Elizabeth St. Ext, Mechanicville, NY 12118 - Building roof - On or about May 17, 2021, employees were performing roof decking replacement on the building roof. As the damaged roof decking was being removed, it left holes within the roof, in which employees were not protected from falling though. Employees were exposed to fall hazards of approximately 40' from the upper roof to the concrete floor below. An employee fell through the rotted roof decking, resulting in fatal injuries.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) At the facility, 1050 Elizabeth St. Ext, Mechanicville, NY 12118 - Building roof - On or about May 17, 2021, employees were exposed to fall hazards of approximately 40' from the upper roof to the ground, and approximately 8' from the upper roof to the lower roof. The employees were replacing rotted roof decking on a flat roof. The employer did not provide an effective training program for the affected employees exposed to fall hazards to enable them to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) At the facility, 1050 Elizabeth St. Ext, Mechanicville, NY 12118 - Building roof - On or about May 17, 2021, employees were performing roof decking replacement on the building roof. Employees were exposed to fall hazards of approximately 40' from the upper roof to the ground, and approximately 8' from the upper roof to a lower roof below. The employer installed a warning line around the roof, but no other protections were in place. Employees were performing work on the perimeter of the roof outside the warning line. An employee fell through the rotted roof decking, resulting in fatal injuries. The Tri-City Roofing and Siding, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1224734, citation number 1, item number 1 and was affirmed as a final order on June 5, 2017, with respect to a workplace located at 70 Pittsfield Rd. Lenox, MA 01240.
