29 CFR  1910.178(l)(2)(i):Trainees may operate a powered industrial truck only:  (A)  Under the direct supervision of persons who have the knowledge, training, and experience to train operators and evaluate their competence; and (B)  Where such operation does not endanger the trainee or other employees.  (A)  Trainee(s) were operating powered industrial truck(s) without direct supervision and/or when there was a potential to endanger themselves or other employees as required.  a) Wilsons Turf located at 128 Kennedy Park Drive Granville, OH 43023:  On and preceding May 16, 2021, the employer did not ensure that a forklift operator that was in training was under the direct supervision of persons who have the knowledge, training, and experience to train operators and evaluate their competence  under conditions which did not endanger other employees.  An unsupervised trainee was operating a forklift moving a pallet  which was lowered on to another workers foot resulting in the worker being hospitalized.

29 CFR  1910.132(d)(2): The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed:  a) Wilsons Turf located at 128 Kennedy Park Drive Granville, OH 43023:  On and preceding May 16, 2021, the employer did not  verify, through a written certification, that the required workplace hazard assessment to identify workplace specific personal protective equipment (PPE) requirements had been performed.
