OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by/caught by hazard from materials moved utilizing a boom.  a) Parking Lot - Unloading Area: Employees were exposed to struck by and caught by hazards as the boom was operated in an unsafe manner, including but not limited to: operating without the safety chain. The Alloy Swivel hook used on a Vestil Boom was not equipped with a safety latch, operating without the safety chain on or about 6/11/2021.The driver of the delivery truck lost a leg after being crushed by falling slabs that were knocked over as the truck bed moved during the unloading operation utilizing a Komatsu Forklift.
