OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from struck-by and crushed by hazards: a) Storage Areas; on or about June 16, 2021, and at times prior to, employees were exposed to struck-by and crushed by hazards while walking, working, or operating powered industrial trucks around metal storage racks.

29 CFR 1910.147(c)(4)(ii):Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): a) Plant; on or about June 16, 2021 and at times prior to, employees expected to lockout equipment including but not limited to robotic welders, ovens, tube benders, hydro-formers, shears, and tube-forming machines were exposed to electrical energy, hydraulic power, and compressed air where the employer failed to include all required steps and information in the lockout/tagout procedures such as but not limited to identification of the equipment, scope and purpose, specific procedural steps, and list and magnitude of all hazardous energy sources the employee could be exposed to.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, and rotating parts: a) Plant; on or about June 16, 2021 and at times prior to, the employer exposed machine operators to amputation hazards, in that the horizontal band sander 1 was not guarded to protect workers from ingoing nip points and rotating parts. b) Plant; on or about June 16, 2021 and at times prior to, the employer exposed machine operators to amputation hazards, in that the vertical band sander 2 (combined with large buffer wheel) was not guarded to protect workers from ingoing nip points and rotating parts. c) Plant; on or about June 16, 2021 and at times prior to, the employer exposed machine operators to amputation hazards, in that the horizontal band sander 3 (combined with small buffer wheel) Asset ID 1801 was not guarded to protect workers from ingoing nip points and rotating parts. d) Plant; on or about June 16, 2021 and at times prior to, the employer exposed machine operators to amputation hazards, in that the horizontal band sander 4 (combined with wire brush wheel) Asset ID 1082 was not guarded to protect workers from ingoing nip points and rotating parts. e) Plant; on or about June 16, 2021 and at times prior to, the employer exposed machine operators to amputation hazards, in that the horizontal band sander 5 (combined with small buffer wheel) was not guarded to protect workers from ingoing nip points and rotating parts. f) Tube Fabrication Area; on or about June 16, 2021 and at times prior to, the employer exposed machine operators to amputation hazards, in that the tube forming machine 1was not guarded on the sides to protect workers from ingoing nip points and rotating parts. g) Tube Fabrication Area; on or about June 16, 2021 and at times prior to, the employer exposed machine operators to amputation hazards, in that the tube forming machine 2 was not guarded on the sides to protect workers from ingoing nip points and rotating parts. h) Tube Fabrication Area; on or about June 16, 2021 and at times prior to, the employer exposed machine operators to amputation hazards, in that the tube forming machine 3 was not guarded on the sides to protect workers from ingoing nip points and rotating parts.
