29 CFR  1910.269(a)(2)(viii): The employer did not ensure that each employee has demonstrated proficiency in the work practices involved before that employee was considered as having completed the training required by paragraph (a)(2) of this section:   IN THE ALTERNATIVE  Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to delays of potentially life-saving cardiopulmonary resuscitation (CPR) when working in buckets at height.  a) Congress and Mirabeaux job site: On or about June 23, 2021, employees worked to move live 23 kV phase lines from a rotten wooden arm without being able to demonstrate proficiency with safety-related work practices including, but not limited to, bucket rescue.

29 CFR  1910.269(l)(1)(ii): Only qualified employees did not work in areas containing unguarded, uninsulated energized lines or parts of equipment operating at 50 volts or more:   a) Bucket at height near phase lines: On or about June 23, 2021, a qualified employee directed an employee that was not qualified to install insulation from a position that exposed his upper arm to contact with an unguarded, uninsulated 23 kV C-phase line.

29 CFR  1910.269(l)(4)(i)(A): The employer did not ensure that when an employee uses rubber insulating gloves, the employee also uses rubber insulating sleeves, if exposed energized parts on which the employee is not working are not insulated from the employee:  a) Bucket at height near phase lines: On or about June 23, 2021, employees installed insulation near 23 kV phase lines without the use of rubber insulating sleeves.
