OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck by falling material and collapsing racks:  a) Freezer Department: On June 21, 2021, and at times prior, the employer exposed employees to struck-by hazards in that the the ends of the industrial storage racks labeled "FH", "FI", and "FJ" had bent and damaged supports and were not bolted to the floor as employees used powered industrial trucks to store inventory on them.   b) Cooler Department, Lunch Meat Cooler: On June 21, 2021, and at times prior, the employer exposed employees to struck-by hazards in that industrial storage racks in the main aisle way of the lunch meat cooler had bent and damaged supports and were not bolted to the floor as employees used powered industrial trucks to store inventory on them.   c) Cooler Department: On June 21, 2021, and at times prior, the employer exposed employees to struck by hazards in that industrial storage racks in the aisle way leading to the forklift maintenance area had bent and damaged supports and were not bolted to the floor as employees used powered industrial trucks to store inventory on them.
