29 CFR  1926.102(a)(1):Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:  a) Roberto Reyes Construction, LLC located at building 7, Highpointe Lakes Drive, WESTERVILLE, OH 43081:  On and preceding July 20, 2021, the employer did not ensure that framers performing work utilizing pneumatic nail guns were provided with and utilized eye protection.  The following condition exposed employees to struck-by hazards to the eyes.

29 CFR  1926.451(a)(6): Scaffolds were not designed by a qualified person:    a) Roberto Reyes Construction, LLC located at building 7, Highpointe Lakes Drive, WESTERVILLE, OH 43081:  On and preceding July 20, 2021,  the employer did not ensure that a platform being utilized to lift personnel using a JLG telehandler was designed by a qualified person. The platform was 144 inches wide and the width of the telehandler was 102 inches without the outriggers extended.  Two employees were exposed to a fall of approximately 30 feet when using the job made platform without guardrails on all sides or any other form of fall protection while collecting tools and debris from a third floor window opening on the east end of the building.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Roberto Reyes Construction, LLC located at building 7, Highpointe Lakes Drive, WESTERVILLE, OH 43081:  On and preceding July 20, 2021,  the employer did not ensure that employees performing framing work throughout the building were protected by guardrail systems, safety net system, or personal fall arrest system at all times when they were exposed to falls greater than 6 feet.  Framers were exposed to falls exceeding 40 feet when working on balconies and near unprotected window openings without utilizing any form of fall protection.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).   a) Roberto Reyes Construction, LLC located at building 7, Highpointe Lakes Drive, WESTERVILLE, OH 43081:  On and preceding July 20, 2021,  the employer did not ensure employees were protected from falls while working from aerial lifts. Employees were working from elevated aerial lifts without fall protection while framing the exterior walls of the fourth floor, thereby exposed to fall hazards of up to 40 feet.  Roberto Reyes Construction, LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1483740, citation number 1, item number 2, and was affirmed as a final order on 08/21/2020, with respect to a workplace located at 5285 High Point Lakes Drive, Building 3, Westerville, Ohio 43081.
