OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards from the equipment itself, the unsecured falling load carried in the bucket and the liquid chlorine contents of the drum.  a)	21 Wilcox Road, outside Maintenance Building, on or about 8-5-21: A Mahindra Model 1626 HST Compact Tractor was operated by untrained employee.   b)	21 Wilcox Road, outside Maintenance Building, on or about 8-5-21: An employee was exposed to the hazards of being struck-by and crushed by a Mahindra Model 1626 HST Compact Tractor by being positioned in the path of travel between the tractor and a fixed object.  c)	21 Wilcox Road, outside Maintenance Building, on or about 8-5-21: An employee was exposed to the hazard of being struck by an unrestrained and unsecured load, consisting of a 55 gallon drum of chlorine elevated and transported in the bucket of the Mahindra Model 1626 HST Compact Tractor.  d)	21 Wilcox Road, outside Maintenance Building, on or about 8-5-21: Employees were exposed to the hazard of a chemical release by elevating and transporting a 55 gallon drum of chlorine unsecured and unrestrained in the bucket of the Mahindra Model 1626 HST Compact Tractor.  Among other methods, one feasible and acceptable method of abatement to correct the hazard is:  Employers shall comply with Association of Equipment Manufacturers (AEM), formerly Equipment Manufacturers Institute (EMI), Page 8, "FOR SAFE OPERATION", paragraph 1 stating: "For the safe operation of this machine, you must be a qualified and authorized operator. To be qualified, you must understand the written instructions supplied by the manufacturer, have training, including actual operation of this machine and know the safety rules and regulations for the jobsite."  Employers shall comply with Association of Equipment Manufacturers (AEM), formerly Equipment Manufacturers Institute (EMI), Page 9, "FOLLOW A SAFETY PROGRAM", Bullet #1 and Bullet #4 stating:  -Know the capacity and operating characteristics of this machine.  -Keep others away from your operation.  Employers shall comply with Association of Equipment Manufacturers (AEM), formerly Equipment Manufacturers Institute (EMI), Page 10, "KNOW YOUR EQUIPMENT", paragraph 1 stating: "Know your backhoe/loader. Know how to operate all equipment on your machine. Know the purpose of all the controls, gauges, and indicators."  Employers shall comply with Association of Equipment Manufacturers (AEM), formerly Equipment Manufacturers Institute (EMI), Page 21, "REMEMBER THE OTHER PERSON", paragraph 1 stating: "Never allow an untrained or unqualified person to operate your machine. Handled improperly, this machine could cause severe injury or death."  Employers shall comply with Association of Equipment Manufacturers (AEM), formerly Equipment Manufacturers Institute (EMI), Page 22,  "TRAVELING ON THE JOBSITE," paragraph 1 stating : "Don't obstruct your vision when traveling or working. Carry the bucket or blade low for maximum stability and visibility.  Carry attachments in transport position. Operate at speeds slow enough so you have complete control at all times."  Employers shall provide specialized training specific to the equipment being used or operated and training on the recognition of the hazards associated with moving materials using a front bucket of a tractor.
