OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards.  a)  At the southeast corner of the parking lot, at 717 West 6TH Street, Waynesboro, GA 30830, on or about August 12, 2021, and at times prior to, the employer did not ensure proper positioning of the excavator's boom, which was suspending a load in the trench with  employees working along side the load, thereby exposing employees to struck-by and crushing hazards.

29 CFR  1904.39(a)(2):  The employer did not report the in-patient hospitalization of one or more employees to OSHA within twenty-four (24) hours:  a)  At the southeast corner of the parking lot at 717 West 6TH Street, Waynesboro, GA 30830, on or about August 4, 2021, the employer failed to report an in-patient hospitalization of an employee who was injured at his job site.
