29 CFR  1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:  a)  New residential construction, Lot 37:  On or about 8/12/2021, the employer exposed a bricklayer who was cutting brick to struck by hazards, in that he was operating a Dewalt D28715  masonry chop saw  without eye protection.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.    a) New residential construction, Lot 37, Front of structure: On or about 8/12/2021, and at times prior, the employer exposed employees to fall hazards up to 21-feet to the lower level, in that a ladder or other safe means of access to the scaffold working platform was not provided as employees climbed masonry walk through scaffold-type frames to access the working level.

29 CFR  1926.451(f)(7):Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  a) New Residential construction, Lot 37, front exterior wall:  On or 8/12/2021, and at times prior, the employer exposed employees to fall and collapse hazards, in that scaffolding was erected by employees who performing bricklaying and were not trained in the hazards of scaffolding and the means to correct the hazards.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b)  a)  New residential construction, Lot 37, Roof:  On or about 8/12/2021, and at times prior, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided employee who were conducting masonry activities on a 4:12 pitched overhang at heights measured at 11 feet 5 inches to the lower level. Employee was standing outside the confines of the scaffolding on the roof overhang receiving supplies from the ground worker and assisting the bricklayers in the task.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) New residential construction, Lot 37, ground level by front door: On or about 8/12/2021 and at times prior, the  employer  exposed  employees to overhead struck-by hazards from buckets, boards and tools in that the employee was working directly below scaffolding without a protective helmet while other employees were engaged in bricklaying  activities.
