29 CFR 1910.178(l)(2)(ii): This standard is applicable to construction employment as defined by 1926.59.  Training  shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  The employer is failing to protect employees from struck by hazards while operating powered industrial trucks on the construction site.  This was recently observed at 7171 173rd Street, Bennington, NE 68007 on August 17th, 2021, where the employer has employees operating a powered industrial truck on the jobsite without operator training.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level.   The employer is failing to protect employees from fall hazards while performing roofing activities. This was most recently observed at 7171 173rd Street, Bennington, NE 68007 on August 17th, 2021 where the employer had his employee(s) suspended on a powered industrial truck mounted scaffold while roofing a residential home, without protecting the employees from falling to a lower level.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  The employer is failing to protect employees from fall hazards while performing roofing activities. This was most recently observed at 7171 173rd Street, Bennington, NE  68007 on August 17th, 2021 where the employer has employees working directly adjacent to an unprotected edge  of a roof.
