29 CFR  1926.501(b)(4)(i):Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  a) 2nd floor Elevator shaft facing stairs: On or about September 2, 2021 and times prior employees walked within 2 feet of an elevator shaft.   The elevator shaft was approximately 18 feet above aground and was not guarded and the employee did not utilize fall protection.  b) 2nd floor elevator shaft upper level: On or about September 2, 2021 and times prior employees walked within 2 feet of an elevator shaft.   The elevator shaft was approximately 21 feet above aground and  was not guarded and the employee did not utilize fall protection.  c) Floor opening: On or about September 2, 2021 and times prior employees walked within 2 feet of an opening in the floor.  The floor opening was approximately 13 feet above aground and  was not guarded and the employee did not utilize fall protection.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:  a) Stairway to 2nd floor: On or about September 2, 2021, employees used the stairway in the center of the building to gain access to the 2nd floor.   The stairway was equipped with 21 risers and was not equipped with a stairrail system on the unprotected side.  b) Stairs to 1st Floor upper level: On or about September 2, 2021, employees used the stairway on the first floor to access the upper level on the first floor.   The stairway was equipped with 6 risers and was not equipped with a stairrail system on the unprotected side.

29 CFR  1926.1052(c)(4):Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members were not provided between the top rail of the stairrail system and the stairway steps:       a) Stairs to 2nd floor: On or about September 2, 2021 and times prior, employees used the stairs to access the 2nd floor to preform carpentry work.  The stair rail system was not equipped with a mid rail resulting in an opening of approximately 38 inches between the stair and the bottom of the hand rail.  b) Stairs to 1st floor upper level: On or about September 2, 2021 and time prior, employees used the stairs to access the first floor upper level to preform carpentry work.  The stair rail system was not equipped with a mid rail resulting in an opening of approximately 36 inches between the stair and the bottom of the hand rail.  c) Stairs to 2nd floor upper level: On or about September 2, 2021 and time prior, employees used the stairs to access the 2nd floor upper level to perform carpentry work.  The stair rail system was not equipped with a mid rail resulting in an opening of approximately 36 inches between the stair and the bottom of the hand rail.
