OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees could have been exposed to hazardous chemical splashes in certain situations while using the valve to a hose for the transfer of sulfuric acid from a bulk railcar to a container in Roberts' facility:  Railcar Transfer Area:  On or about September 3, 2021, a flexible chemical transfer hose used to transfer 93% sulfuric acid from a bulk railcar to containers in the facility failed.  If the failure had occurred when the valve was opened, the employee doing so might have been exposed to sulfuric acid.  The employer did not ensure that its procedures for periodic inspections, testing and maintenance of  the flexible transfer hose used to transfer corrosive 93% sulfuric acid from bulk railcars to other containers were implemented in a timely manner.
