29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  On or about September 22, 2021  employees were exposed to the hazards associated with working in and around a trench that had not been inspected by a competent person.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.652(d)(2):Manufactured materials and equipment used for protective systems shall be used and maintained in a manner that is consistent with the recommendations of the manufacturer, and in a manner that will prevent employee exposure to hazards.  On or about September 22, 2021 an employee was exposed to struck-by hazards while working inside a trench box that was installed with a missing spreader bar.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.652(e)(2)(i):Excavation of material to a level no greater than 2 feet (.61 m) below the bottom of the members of a support system shall be permitted, but only if the system is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the support system.  On or about September 22, 2021 an employee was exposed to struck-by hazard while working inside a trench box that was installed 2.4 feet off the bottom of the trench.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
