29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103) Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.   Company-wide:  On or about October 04, 2021, the employer did not ensure employees fitness to wear a respirator before they were required to wear them. Employees wore respirators while performing tasks that generated dust from cutting and sawing stones.

29 CFR  1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  Company-wide:  On or about October 04, 2021, the employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level while they performed tasks that generated dust from cutting and sawing stone. Employees utilize equipment that include, but are not limited to, two stone splitters (Model: Steinex CCOVZ1014, Igloo SNENPA460) that are not equipped with engineering controls to mitigate the suspended dust.
