29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d): 29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. a) Residential Site: On or about October 13, 2021, and at times prior thereto, workers were operating a Skyjack SJ1056 Telehandler to move materials without training on its safe operation. b) Residential Site: On or about October 13, 2021, and at times prior thereto, workers were operating a SkyTrak 10054L 4WD Telehandler to move materials without training on its safe operation.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee who might be exposed to fall hazards that would enable each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards: Residential Site: On or about October 13, 2021, workers were exposed to a fall hazard greater than 6 feet to the ground below, while installing roof trusses without being trained in recognizing and addressing fall hazards.
