OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that skid steer operators were exposed to rollover/struck by/caught between hazards while operating the John Deere 260 skid steer loader:   a)	Doren, Inc. dba Omni Precast., Outside Pit area of the facility, on or about October 19h, 2021 and times prior thereto:  An employee operating a John Deere 260 skid steer loader (Product Identification Number KV0260B360330) lifted a load of sand in a manner that caused the loader to rollover and then fall from the hopper area to the ground surface of the pit below. The loader's bucket was raised to a height that was greater than the manufacturer's requirements  while traveling with a loaded bucket, in order to dump loads of sand into the pit hopper area.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
