29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  a) On or about 12/09/2021, at the former  Xerox Building and during the development of Innovation Square Student Housing, the employer did not enforce the safe use of a ladder, allowing employee(s), to use the top step of a step ladder to access  the upper level of an enclosure on the first floor.   Employees are exposed to falls from using ladders in a manner other than intended by the manufacturer.  NO ABATEMENT CERTIFICATION REQUIRED
