29 CFR 1926.652(a)(1)(ii): Each employee in an excavation was not protected from cave-ins in that the excavation was less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provided an indication of a potential cave-in. (a) Roche Constructors, Inc., 717 71st Ave., Greeley, CO 80634: On December 13, 2021, the controlling employer did not ensure that subcontractor employees who were working inside a trench that was approximately 4 feet 6 inches in depth were protected by an adequate protective system. A subcontractor employee who was retrieving a shovel from inside the trench sustained serious injuries when he was struck by section of a trench wall that collapsed. The trench had near vertical walls, type B soil, and visible cracks and fissures as well as sections of soil sloughing into the trench. This condition exposed subcontractor employees to a crushing hazard by excavation wall cave-in. (b) Roche Constructors, Inc., 717 71st Ave., Greeley, CO 80634: On or about December 13, 2021, the controlling employer did not ensure that subcontractor employees who were hand-digging and removing pipe from the bottom of a trench that was approximately 4 feet 6 inches in depth were protected by an adequate protective system. The trench had near vertical walls, type B soil, and visible cracks and fissures, as well as sections of soil sloughing into the trench. This condition exposed subcontractor employees to a crushing hazard by excavation wall cave-in.
