29 CFR  1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition:   Employees are exposed to hazardous energy from a forklift. On or about December 17, 2021, the Nissan forklift Model: MCP1F1A18LV was not properly locked out and tagged out. Maintenance had moved a forklift out of operation due to brake issues. The only form of lockout tagout used on the forklift was a cover that laid on the steering wheel. Employees had removed the cover that morning and used the forklift to move materials. There was no other form of lockout tagout available for use as the lockout tagout station was empty and had not been maintained by the employer.

29 CFR  1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:   Employees are exposed to explosion hazards associated with repairs not being made to the Nissan forklift Model: MCP1F1A18LV. The bracket that holds the compressed gas cylinder onto the forklift was broken allowing for the tank to move while in operation. The forklift had been used that day.
