29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface: a) At site, 2nd floor Hoist Area - On or about January 18, 2022 and at times prior thereto, employees were exposed to fall hazards of approximately 10 feet due to a guardrail system guarding the hoist area opening that did not have a top rail of 42 inches plus or minus 3 inches. The 1KB & MS LLC, dba Kingston Block & Masonry LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.29(b)(1), which was contained in OSHA inspection number 1240159, citation number 1, item number 1b and was affirmed as a final order on June 14, 2019, with respect to a workplace located at 1 Kieffer Lane, Kingston, NY 12401.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) At site, Block Plant Area - On or about January 18, 2022 and at times prior thereto, employees perform service and maintenance activities on Block Machine 1 (Manufactured by BESSER CO., Serial No. 1336, Model No. PRC86-R4). The employer does not have and/or follow an adequate lockout/tagout program consisting of an energy control procedure, employee training and periodic inspection. b) At site, Block Plant Area - On or about January 18, 2022 and at times prior thereto, employees perform service and maintenance activities on Block Machine 2 (BESSER). The employer does not have and/or follow an adequate lockout/tagout program consisting of an energy control procedure, employee training and periodic inspection. c) At site, 2nd Floor Mixer Area - On or about January 18, 2022 and at times prior thereto, employees perform service and maintenance activities on Mixer 1/B. The employer does not have and/or follow an adequate lockout/tagout program consisting of an energy control procedure, employee training and periodic inspection. d) At site, 2nd Floor Mixer Area - On or about January 18, 2022 and at times prior thereto, employees perform service and maintenance activities on Mixer 2/A. The employer does not have and/or follow an adequate lockout/tagout program consisting of an energy control procedure, employee training and periodic inspection.
