29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a. On or before January 28, 2022, the employer did not ensure employees were competent to operate powered industrial trucks. An employee was operating a forklift without having completed powered industrial truck training which resulted in the forklift damaging the dust collector system.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a. On and/or before January 28, 2022, the employer did not ensure employees were protected from the rotating parts of the auger on the dust collector hopper. While changing out dust collector bags, the employees are exposed to the rotating auger through the unguarded chute opening.

29 CFR  1910.305(b)(1)(ii):Unused openings in cabinets, boxes, and fittings shall be effectively closed.  a. On and/or before February 7, 2022, the employer did not ensure unused openings in electrical cabinets were closed. There was an unused opening in the electrical cabinet of the dust collection system, thereby exposing employees to a 120-volt electrical contact hazard.
